  Bats and their roosts are highly protected by UK and EU legislation, even when the bats are absent from the roost. They are also protected from disturbance, which extends to altering the temperature and humidity of a roost.

Contrary to popular belief, bats will roost in both old and modern buildings, and will enter in through the smallest of holes or cracks.

The presence of a bat roost on site can require complex mitigation to be put in place and since bats also require flyways of trees and hedges, simply protecting a roost may not be suitable to satisfy Natural England.

Any works which may intentionally kill, injure, capture or disturb a bat, or destroy, damage or obstruct access to a bat roost will require a licence from DEFRA and/or Natural England. Development licences, which can permit activities which would potentially impact upon bats, take at least 30 days from application to issue.

Works on hibernation roosts can only be undertaken between May and September. Works on maternity roosts should be undertaken between November and March but may be able to start in mid-September and carry on until May.
