  Under the Wildlife and Countryside Act 1981, all wild birds, their nests and eggs are protected by law, with Schedule 1 species such as the Barn Owl, offered further protection.

It is an offence to:
  • Recklessly kill, injure or take any wild bird;

  • Take, recklessly damage or destroy the nest of any wild bird while it is in use or is being built;

  • Take or recklessly destroy the egg of any wild bird; and

  • Recklessly disturb any wild bird listed on Schedule 1 of the Act whilst it is nest building, or is at (or near) a nest with eggs and/or young, or to disturb the young of such a listed species.
It is important that birds are considered early in the planning process as the seasonal nature of vegetation clearance and survey work can impact upon the development process. This early approach will allow timing of works including clearance, to be programmed.
